Q: I have been working with my bank on a loan modification, but just received a notice of foreclosure. I contacted the lawyer who is handling the foreclosure process, but she said she is acting on instructions from the lender and there was nothing she could do about stopping the process. Whats going on, and what remedy do I have?A: This is a nationwide problem: The bank and the banks lawyer are just not communicating with each other. But help is on the way. In May, for example, the Supreme Court of South Carolina ordered lenders not to foreclose until they can demonstrate that they have given homeowners a meaningful opportunity to modify their loans. And the demonstration must be in the form of a certificate filed with the court.
